As regulatory compliance has become a leading concern for multinational companies working in Latin America, more corporations are turning to due diligence providers to investigate potential business partners in hopes of mitigating their legal exposure.
It's a growing field. Third-party due diligence has become one of Berkeley Research Group's fastest-growing areas, encouraging them to open an office in Miami in the last year and in four Latin American countries by the end of March, said Frank Holder, BRG's head of Latin America. California-based BRG also offers services such as expert witnesses, global investigations into compliance, forensic accounting and cybersecurity. Since he was hired by BRG in June, the company has hired 60 people in Miami, Mexico City, Panama City, Bogota, Sao Paulo and soon Buenos Aires.

Atribuir los problemas de sobornos y falta de transparencia a un fenómeno de usos y costumbres es una excusa utilizada por las empresas para no cumplir con la ley, afirma Frank Holder, presidente para Latinoamérica de FTI 'Consulting'
La corrupción no es un problema cultural de la sociedad, tiene sus raíces en instituciones gubernamentales débiles y falta de transparencia del Estado.
Frank L. Holder, presidente para Latinoamérica de la consultoría de escala mundial FTI Consulting, explicó en entrevista cómo algunas empresas (sobre todo las transnacionales), utilizan pretextos para no cumplir con el marco regulatorio.
“Exageramos las diferencias culturales porque es una excusa conveniente para no cumplir con prácticas transparentes en un determinado país”, afirmó Holder.
Sin embargo, la corrupción se deriva principalmente por carecer de órganos regulatorios eficientes.
“La corrupción es producto de una debilidad institucional y no necesariamente una cuestión vinculada a lo cultural”, explicó.
Esto se puede apreciar si comparamos el nivel de corrupción de varios países que mantienen una relación cultural muy estrecha.
“Al analizar diferentes países de América Latina, que comparten una herencia cultural muy parecida,” argumentó Holder al analizar México, “tienen bastante diferencia en términos de los ranking de corrupción y percepción de corrupción”.
Mientras que México se ubica en niveles muy bajos en transparencia internacional, Chile sale bien evaluado.
Si el problema fuera exclusivamente cultural, habría menos variación en la región, aún y cuando América Latina es una de las regiones con mayor corrupción en el mundo.
La historia latina se ha visto marcada por Estados que muestran un gran énfasis en la producción económica y dejan a un lado su papel como reguladores de entidades privadas.
En opinión de Holder, también existen problemas culturales, pero no son el principal factor que promueve la corrupción.
Cuando haces una encuesta en México y más del 30 por ciento admite haber realizado un acto de corrupción en el año, existe un problema.
